- Request Procedure for Access to Records
To access records, complete the prescribed Form C (available on the SAHRC website), and submit it along with the applicable request fee to the Information Officer. Provide sufficient detail to identify the record(s) requested, your identity, and preferred method of access.
Access will be granted if:
- The record is required for the exercise or protection of a right; and
- No grounds for refusal under the PAIA or POPIA exist.
- Grounds for Refusal of Access
Access may be refused where it would:
- Unreasonably disclose personal information about a third party
- Endanger the life or safety of an individual
- Compromise commercial or confidential information
- Violate legal privilege
- Remedies Available Upon Refusal
If access is refused, the requester may:
- Submit an internal appeal to the Information Officer
- Approach the High Court for relief
